Dear client any husband has to give maintenance to his wife and his son or daughter born out of the legal marriage. if your husband is claiming that he is not working but he has duty to maintain his family and as you are telling that he is software engineer so he is capable enough to earn the money and maintain his family so you have all rights to ask for maintenance and He is bound to give the maintenance to his son and his wife. So you will get it.

Dear Sir, Whether husband earns or not depending upon his qualifications and family properties, monthly maintenance will be awarded. You are advised to file maintenance case under Section 125 of Cr.P.C for yourself and your son and most probably you may get monthly maintenance below Rupees Ten Thousand.
