Maintenance For Unemployed Husband

I lost my job in lock down and also due to unwell health condition my wife as professional make up artist earn more than i use to earn but she takes money in cash ...ll i be able to claim maintenance from her ??? As i was summon for montly maintenance Rs 22000 under 125 crpc ..please suggest.

the legal ground has to be proved in court that you have lost your job as being a jobless it is highly impossible for you to live your livelihood so you are unable to give maintenance ordered by court what is your jurisdiction....

125 is not gender neutral provision. so it is one thing to defend the 125 and another thing to initiate a case for maintenance against your wife under the personal law (hindu law) in case you have married under the hindu marriage act. you can place your predicaments before the court and get relief

a wife is solely and wholly dependant on a husband even if she is earning moreover husband cannot escape from the mandatory maintenance of wife and a wife cannot be asked to maintain a husband and 125 crpc doesnt allow the same
