Maintenance for child from seperated husband

I was married in 2016.I am working ,hindu.My daughter was born in 2018.After her birth my husband's emotional abuse turned to physical and he misbehaved with my parents several times. He seperated me from my parents and started asking for money from me.His mother asked me for my whole salary. I didn't give them my whole salary, saved money in bank for my child and gave them small part.I kept quiet for my child. During lockdown in sept'20 I left their place and came back to my parents place. My husband usually used to beat me and then hurt himself to show that he is victim. He initially asked me to come back but I refused.He loved his daughter. But now he never calls. If I call he talks with daughter but refuses to give any money for her. He denies to come for her school admission too.I don't want divorce but want maintenance for my daughter by section 125.He is a professor in a govt college. I am a private employee with low and irregular income compared to him. What can be his action?

he will file a restitution case to get you back and avoid maintenance rather than going for 125 you can opt for dv its a better platform to allegate him with several other options of physical torture as per law he is bound to maintain daughter

Your husband may file a restitution case to get you and your child back home and avoid maintenance rather than going for 125 you can opt for Domestic Violence case, its a better platform to allegate him with several other options of physical torture as per law and your husband is bound to maintain daughter, detailed planning is a necessary to penalise your husband at best interest of you

he is responsible for the maintenance of both you and your daughter. find a lawyer and sue him accordingly. irrespective of your income he being able bodied and earning handsome income owes responsibility to you and your child for your maintenance.
