Maintenance and property rights issues

19-May-2023 (In Divorce Law)
My husband has filed for divorce and is not giving any maintenance inspite of we having signed a MOU ( it is Registered) whereby he has agreed to pay my share from a lent out property generating a lease income. Our share is in the ratio of 60:40 so will the court grant me my maintenance and rent sharing rights on the basis of breach of MOU. Property is on husbands name. Before filing for divorce he used to pay my share but discontinued there after. It is clearly agreed by him that he will pay me the agreed sum every month but now he has stopped paying past 19 months. In the beginning He has payed for 2 years. Please Help and Thank you

As per the MoU you are entitled to claim your share and if that is not paid, you can file a suit for recovery of amount. In addition to that amount you can also claim maintenance which would be separate from the amount you receive from the MoU.
