Maintainace from husband for adultery and cruelty
11-May-2023 (In Divorce Law)
Hi,
My husband and I were married in 1996 and we have a 22 year old daughter. My husband is a well-established CA who earns at-least 10L a month. He drives a luxury BMW car and also has at least 4-5 plots and a building with 8 1BHK homes.
I have filed a contested divorce against him on the grounds of cruelty and adultery.
What is a reasonable amount that I can ask from him for maintainace? Can I ask him maintainance for our 22 year old daughter for the higher-education and marriage purposes?
I am a house-wife and I don't have any monthly income. I am the joint-owner of a few properties with my father, who is of 79 years of age. But I do not get any income from the property whatsoever.
We are Hindu family based out of Chennai.
Generally, courts award 1/4th of the husband's income to the wife as maintenance. In a case last year, the Supreme Court also set the benchmark at 25% of husband's net salary as the amount for maintenance as “just and proper”. An unmarried daughter is entitled to claim maintenance from her father even after attaining the age of 18 if her parents are divorced or estranged, the Bombay High Court has ruled.
