Living separately want to file for divorce and child maintenance

I am separated from my husband for the last 1.5 years. Would like to know if I want to file a divorce with child (girl) maintenance, what is the procedure if he is not earning at all.

You may file divorce and maintenance petition , your husband is bound to provide you and your child monthly allowance , during pendency of petition court may allow interim maintenance till tha disposal of case

you need to prove court his earning for maintenance. rest divorce has different grounds
this will include if any ancestral property is available. better contact a lawyer or me personally.

Hi, First of all if u r separated with your husband more then one year in that manner u can file for divorce.
But important thing is u both mutually want divorce or only u want divorce? But if u want divorce u can file and also can claim for maintenance for ur child.
basically maintenance depend on husband earning , on that manner court decide how much u will get.

do file section 9 and 13 in family court for maintenance in family court you can file in-spite of if he is not earning he has to maintain his family but if you have no source of income if he shows that you have a source of income then consult your competent lawyer.
