Legalities of infidelity and severence of marriage peacefully

16-Aug-2023 (In Divorce Law)
I am in a relationship with another married woman for few years now. I am married too with a child but my wife is a crooked woman who had already divorced twice before marrying me, exiting previous marriages with good alimony amounts. We are NRIs and all my properties are registered in her name. She has harassed me and abused me over years. I want to get out of this woman and start anew. She has recorded conversations of me and my lover. Some chat exchanges, emails, photos are with her too. She is an extortionist who wants only money and has been using the child. Every relative, family and friend is siding her and alienating me. I have filed for divorce in India. Kindly advise on my rights and threats and limitations. My wife is threatening to put me and my lover behind bars.

Good evening sir You have 2 options, (1) file for a mutual divorce wherein the consent of your wife would be required, the rider here would be that a settlement would have to be entered with your wife (2) the second option that you have it to file for a contested divorce which would take more time.

In your case you can totally prove that as your wife was previously married twice and extorted alimony from her past husbands you can prove her intention of doing the same with you and if you believe that she is a crooked woman then you can file a domestic violence case against your wife in the court and get it on the basis of cruelty in India. You can go for a divorce on mutual basis but listening to your statement I do not believe that your wife will happily divorce you without extorting amount from you so I will suggest you to put a divorce matter in the court of law under the cruelty circumstances
