Legal separation child custody mental harassment

I have been married for 6+ yrs. This is our 2nd marriage. We have 5 m old baby boy. Don't have any other kids. I want to get separate from my husband and custody of my 5 m old baby. This marriage was never ever happy. I feel humiliated and insulated everyday. Lots of interference from his parents and family. There is no love and affection. I m on depression pills from 4 yrs but now I have stopped taking them and made my self stronger to get out of this. My main problem is I am financially dependent on him and not able to give good upbringing (financial) to my son as of now. Can Indian law help me. I have mentally and emotionally harrassed by him but there is no demand of dowry ever, so there is no 498. Can indian law help me in this scenario.

You are required to share more facts. With respect to proposed divorce, mental harassment is a valid ground alongwith violation of Section 498a, as well.
About son, definitely he shall be under your custody alongwith maintenance under Section 125.

hello,
Madam ur main problem of saperation from husband due to lack of love & affection. U file a divorce suit in court. Ur child only 5 month old at this stage child lives with u. For the child feature u also file a maintenance suit against ur husband.
