Legal rights to protect from toxic husband

12-Aug-2025 (In Divorce Law)
My husband is addicted to alcohol. He promises to stop drinking every time but doesn't stop. Whenever small problem arises or I am not around him, basically he finds reasons to drink and drinks continuously without thinking anything about money health relationship and work. I feel insulted in front of everyone with his abusive behaviour. When asked about his behaviour he curses me and my family. I am feeling mentally abused by him and constantly in fear that he binge drinks and behaves rudely.

Your husband’s alcohol addiction and abuse are hurting you. His broken promises and rude behavior are not okay. You deserve respect and safety. Seek help from family, friends, or a counselor to protect yourself. Stay strong.

hi if he is regularly abusing him regularly and torturing then you could file petition for domestic violence and could obtain compensation for violence and also for divorce on grounds of cruelty and mental torture

You have strong legal grounds to act. Continuous alcohol abuse, verbal abuse and mental cruelty are valid reasons for divorce, under cruelty provisions in Indian law of the Hindu Marriage Act . You may also file a case under the domestic violence Act for protection, residence and maintenance. Document all incidents and, if needed, seek police protection. Prioritize your safety and mental health while initiating legal proceedings .

Your husband’s repeated alcohol abuse and abusive conduct amounts to mental cruelty under Section 13(1)(ia) of the Hindu Marriage Act, which is a valid ground for divorce. His insults towards you and your family, public humiliation, and aggressive behavior also fall within the Domestic Violence Act, 2005—where you may seek protection orders, residence rights, maintenance, and even compensation.
