Issues with my Mother and father during 34 yrs of marriage

My Father and Mother are married for 34 Yrs. He is 74 and she is 57. It was a arrange marriage. My father never supported my mother financially nor mentally and always insulted her. As now I am working he wants my mother stays with me and he wants to sells the only shelter (Flat) as he is saying he donot have any money left and he want to sell the property which is in his name. My mother also contributed and sold her jewelley for flat but she donot have papers. I am supporting my family financially but he keep demanding more and also donot want to share even 2000 rupees per month towards family. He is quarreling day long everyday to irritate and pressurize my mother to leave the house. His brothers are supporting him. I am fine to keep her in rented house with me but is she not eligible for any financial support after staying for 34 yrs. He never paid my college fees also. plz suggest if we can stop him to sell or separate her with financial support. She don't want to become my burden.

By making complaint against your father for domestic violence, your mother can pray therein for maintenance from your father as well as residence Order so that your father cannot make her shelterless by selling his house.

As per your query in law rato, yes your mother can file a maintenance case from your father and ask for maintenance from your mother. Hence you can file a case against your father on the ground of cruelty.
