Issue related to child visitation

मेरी पत्नी ने जनवरी 2021 में women सेल में complaint की 498a और dv की, फिर कोर्ट में हमारा mediation चला और mediation फेल हो गया, अब case वापस women cell में है,
मेरी एक 4.5साल की बेटी है, अब 10 महीने हो गए हैं मेरी बेटी से मिले और बात किए,
Visitation का case डालने के लिए वकील को बोलता हूं वो मना करता है कि अभी कोर्ट में divorce, DV, 125, 498a कोई केस नही चल रहा है। तो हम visitation नही डाल सकते। बच्ची 5 साल से काम है तो child custody भी नही दल सकते।
क्या ऐसा सच में हैं कि जबतक केस कोर्ट नही आयेगा, मैं visitaion के लिए apply नही कर सकता?
Please help मैं बिना child custody Case डाले visitaion के लिए कैसे apply करूं?
hello client as you are saying tht your advocate is saying can not file the case. in fact your case is totally liable to be filled on urgent basis as your case is already failed in mediation cell and its definate now tht caw cell will file FIR against you . in these facts you shouod file the case of chiod custudy as well as chile visitation rights as well in this case your advocate is totally wrong ij his advice and if this is the thing you should reconsider your thought .

You can just file a application/reply regarding the custody of the child before the CAW so that in later stage if have evidences that you wanted the custody and she was denying. It may prove beneficial for you at later stage. And why don’t you initiate with the filing of the case against your wife if you don’t want to live with her.

i will suggest ki aap court me divorce case daal dijiye. pehle women cell se report lijiye ki hume yaha koi solution ni mil raha hai. hume court ko approach karna hai. fir us report ke baad aap divorce case daaliye court me jiske sath aap visitation application daal sakte hai.
