If we got married in 2019 through Arya samaj but our marriage is not registered and we both were living in our parents house separately and 2021 we got break up then, is it necessary to take a divorce?? Is my marriage is valid? As we both lived separately and didn't talk to each other for about 1.5 year??

Yes…your marriage is valid according to the Hindu Marriage Act. And accordingly you both have to go through divorce to dissolve your marriage. I would advise you to go through the mutual divorce because it’s cost effective and ends up in maximum of six months. For more legal assistance I am just a call away.

Hi..!! Your marriage is very much valid. You have to take a proper divorce, leaving separately will not be considered as divorce. You both will still remain husband and wife until you take proper divorce through court.

Arya samaj marriages are valid marriages so therefore you will need to take divorce to dissolve the same. depending on whether your spouse wants to stay or not in the marriage, you may consider filing for mutual divorce or contested divorce. mutual divorce saves time, effort and resources.
