Is money transfer during marriage enough for getting jail

11-Jun-2024 (In Divorce Law)
I am fighting a 498(a) case.My wife did not provide any evidence for cruelity and I got bail for that reason from high court. Right now we have to face charges and undergo trial to prove that we have not demanded any dowry. She has written that we have received x and asking for 3x, where as actually her father had given x/4 as a cheque on marriage mandap. That amount was later in my father's bank account. Is that money transfer is enough to sentence us for jail ?

Dear Sir, The cheque deposited in the account of your father by your father-in-law is a strong evidence. You are advised to prolong the matter by deviating from surrendering for trial. File Discharge application if charge sheet is filed and if dismissed then approach High Court thus matter will be prolonged and evidence may be started after three years by that time all circumstances and mind sets of witnesses and police officers will be changed.

1. you have to prove that the amount paid by them is not demanded by either your father or you. 2. they have to prove that on your and your parents demand , they agreed to pay dowry. 3. your advocate will get a chance to cross examine the opposite party
