Is it legal to use audio spy recorder for recording your spouse

Hello,
Pls let me know if it is legal to use audio spy recorder for recording your spouse's communication with his/her office colleague if you suspect your spouse is having an special relationship with that colleague.
Can the court accept such recording as a proof of adultery or intention of cheating spouse leading to punishment to the cheating spouse or 'seeking a divorce without any alimony of financial burden on the impacted spouse'.
dear friend first of all you can erode any one's privacy.
secondly spying on your for finding the fact will be allowed but now in law adultery is not criminal even before it was not punishable for women. but you can divorce her on the point of adultery if it is proved in the court.
the instruments which you are using will that be accepted or not cant be said now as under what circumstances you have recorded the thing there wont be any witness to that.
