Your case clearly discloses grounds of cruelty and desertion. Continuous neglect, insults, and 5 years of separation are sufficient to seek divorce under law. You need not file “only maintenance” first. You can simultaneously seek: 1. Divorce on grounds of cruelty/desertion 2. Permanent alimony (lump sum settlement) 3. Recovery of money lent to your husband (subject to proof) Long separation, though not an independent ground in all cases, strongly supports breakdown of marriage and strengthens your case. If mutual consent is not possible, the best course is to file a contested divorce petition on cruelty and desertion, along with an application for interim maintenance during the pendency of the case. Considering your unemployment and financial condition, the court can grant maintenance and suitable compensation. You should immediately initiate legal proceedings to secure your rights rather than waiting for any action from your husband.
