Is Bail required for 498a when Mutual consent is in progress
18-Feb-2025 (In Divorce Law)
HI,
My mutual consent petition is submited and is in evidence stage . Its on hold till 498a is withdrawn . The first summon for 498a is next month , i was told that i need to take bail for which i need to provide PHANI which i dont have.
Is it mandatory to take bail for 498a when mutual consent is in process , or can wife give hostile evidence even before bail. what are alternatives as i dont have PHANI
first of all if the matter is settled,
go before the court and advance the matter and obtain bail by giving cash surety with your wife's consent.
and later
you have an alternative
you can file quashing petition before High Court
file the compromise petition or settlement agreement
ask your wife to accompany you petition and file an affidavit
the court after verification and confirmation will quash d FIR charge sheet and enter proceedings
then after quashing you can proceed with your mutual consent
