IPC 498A and divorce, if she misuse of 498A than what are option forme

I got married 4 years ago and we have one baby girl 2.5 years. Due to her parents mostly her mother, She always fight even she do physical abuse with me. She didn’t respect to my any family members even we lived in nuclear family. They people never understand to their daughter. I really very frustrated. Please advice what to do.

try any reconciliation with wife if possible. in 498 if there is no understanding and police finds matter is not serious than they will not arrest. else you can obtain bail from lower court or higher court. also u should send Divorce notice to ur wife.

tel me the police report lodge or not. if it is lodge than you hav only one remedy that get anticipatory bail. or you can approach in high court for quashing the FIR. hopefully there you get some remedy.

First of all you should send a legal notice to your wife to live with you and perform her duties towards you as wife and thereafter file a petition against your wife for section 9 of hindu marriage act for restitution of conjugal right. if your wife still not ready to live with you then you should file a petition against your wife for divorce on grounds mentioned in the section 13 of Hindu Marriage Act . if your wife has already filled a complaint under section 498A IPC etc then should go for quashing of F.I.R before concerned high court or apply for anticipatory bail before district judge court. if you want any further information or any other advice then contact me without any hesitation or come to my office
