Marriage date: 24.02.2019 (love marriage after live-in relationship)
Date of separation: 23.09.2019
Date of 1st complaint: 24.09.2020
Mediation failed from her side.
Court ordered for interim maintenance of 5k /month
She is working and getting a good salary.
I’ve details of her bank account in which her salary is credited.
Whereas I’m jobless.
How should I prove her job and salary in court.
As I can’t present her bank statement since it’s illegal I guess.
I’m paying Maintainence from last 4 months.
Court has ordered to submit income affidavit of both parties. I’ve submitted but she has not.
Without the perusal of the income affidavit, if the court has granted maintenance then you can assail the same. Also you need to show her employment in any company and her earning needs to be proved. Let her file a income affidavit. If there will be any wrong information in the affidavit that is also a criminal offence. And if she is earning and is capable to maintain herself and you are completely jobless then you may not pay her anything. It a matter of arguments in the court.
