Inquiry Regarding Maintainability of GWOP Case

Married 13 years ago to husband from Anantapur, Andhra state; endured physical abuse. Filed 498A complaint in Bangalore police station a year ago. Our 2 daughters, aged 11 and 3, reside and study in BLR for about a year. Aadhar and passport of kids, list BLR address. Husband filed RCR and GWOP case in his home city, anantapur, Andhra. Pls Let me know the maintainability of GWOP case. Received summon notice but didn't attend; case pending with new summon dates. How should I proceed ?

You filed 498A in Bangalore and have all id proofs of Bangalore. I presume you both lived in Bangalore for a couple of months.
if my presumption is true then the Anantapur Court has got no jurisdiction to deal with this case. Just because he is residing now back in Anantapur the court doesn't get jurisdiction. Husband will most likely not succeeded in GWOP cases where the child is a girl even though Father is a Natural Guardian.

You may delay the hearings or rush right away to state that it has got no jurisdiction. In these type of cases people usually delay it to make the other party suffer.

hi first need to see the contents of the GWOP filed by him and the grounds raised in it and if you want to transfer the case from one state to another state then you could file petition in supreme court to transfer the case
