Religion - HindunnMy brother got married in 5th December 2021, and the marriage has been ugly till date..My brother works in siliguri and sis-in-law in bangalore... They have lived together under same roof for like 2 months tops in siliguri..She lived like 2.5~3 months in her own parents house and 2.5~3 months with in my parents house and my brother used to come home starting of every month once and now she is living in bangalore since july. nnThe marriage has not been connsummated yet as she refused on multiple occasions and then my brother simply stoped trying. nnThere was hardly any affection between the two of them and according to my brother whenever they talked it would simply be an argument and topic being same about her complains regarding our familyDuring the time sis in law lived with my parents in kolkata she had issues with all of the family members including my brother, and has been non cooperaritive/adjusting to our family ways since the start...

To give opinion, it is necessary to know whether your brother is willing to get divorce or he wishes restitution of conjugal rights. To get legal advice on this issue upon online payment, you can whatsapp.

yes your brother may contemplate moving a suitable petition under the hindu marriage Act before any of the jurisdictional court which would be able to adjudicate on the issue and grant relief accordingly as prayed therein. a better option would be to let the spouses talk amongst themselves and agree for a mutual divorce in terms of the agreed terms and conditions which will be convenient and mutually acceptable and would give a expeditious result which will also have the advantage of less acrimonious litigation and resultant bad blood between two families or individual as the case may be. if the marriage has not been consummated then your brother needs to prove that so that after the divorce your brother doesnt get the tag of the divorcee which is very depressing because if not consummated then marriage is null and void and moreover it is very important to hire a technical lawyer to counter the tantrums of the wife herein
