In your income affidavit, make a full and truthful disclosure of all your income, assets, liabilities and bank accounts. It is advisable to disclose salary slips, salary account statements, all individual bank accounts and any joint account where you are a holder, while clarifying that your mother is the primary account holder and you are only a secondary holder. Suppression of financial information may adversely affect your case. Since you are a government employee, maintain complete transparency and file documents as directed by the Family Court.
for government employees it's very hard to hide income there is only one way to tack loans as possible as and on salary loan amount must bi deducted from salary then in A and L affidavit you can mention loan and join loan deduction papers and tack advantage of minimum wages act
As a govt employee, disclose truthful income and assets. Generally file salary slips, salary account statements and details of accounts/assets beneficially owned or jointly held, as required by court.
you will have to deal with the demand with a proper reply, is your wife working? if you are in benefit and if not then you will have to pay a certain amount but 1 cr is too much. Deal in your reply that you don't earn that much
In divorce and maintenance proceedings, the Hon'ble Supreme Court in _Rajnesh v. Neha_ has mandated filing a detailed Affidavit of Disclosure of Assets and Liabilities by both parties. As a government employee, you must be transparent and truthful in this affidavit, as concealment can lead to adverse inference by the court.
You should attach the following documents with your income affidavit:
1. *Salary Slips:* Last 12 months' salary slips from your government department.
2. *Salary Bank Account Statement:* Last 3 years' bank statement of the account where your salary is credited. This is mandatory.
3. *All Individual Savings Accounts:* Last 3 years' statements for all savings accounts held solely in your name.
4. *Joint Account:* Statement for the joint account with your mother must also be disclosed. Since you are a secondary holder, you must specify that your mother is the primary holder and the source of funds in that account. You should attach a note explaining that the funds are primarily your mother's.
Hiding any account can be treated as perjury. The court assesses maintenance based on your net disposable income after statutory deductions, your liabilities, and your wife's income and lifestyle. A 1 Cr demand is not granted automatically; it must be justified with evidence.
For drafting a proper affidavit and to counter an unreasonable demand, it is advisable to engage an advocate. You may book a consultation through my LawRato profile for case-specific guidance.
