In your income affidavit, make a full and truthful disclosure of all your income, assets, liabilities and bank accounts. It is advisable to disclose salary slips, salary account statements, all individual bank accounts and any joint account where you are a holder, while clarifying that your mother is the primary account holder and you are only a secondary holder. Suppression of financial information may adversely affect your case. Since you are a government employee, maintain complete transparency and file documents as directed by the Family Court.

Q: Expected wait time for divorce decree

Spouse ran away with another man 3 years back. Lodged missing report on the date of disappearing. Notice sent to both, news paper publication done, exparte order is announced. I was asked to the witness box on the last hearing, as per my advocate, evidence is closed, how many more hearings are generally required as per your experience to get the exparte divorce decree ? Since your evidence has been recorded and the matter is proceeding ex parte, the case is generally fixed for final arguments and then judgment. If there are no procedural delays, the ex parte divorce decree may be passed within 1–3 hearings, subject to the court's workload.

If the sisters merely signed an affidavit or No Objection Certificate based on certain promises made by the brother, and those promises were not fulfilled, they may challenge the transaction by approaching the competent civil court. However, if a registered Gift Deed, Release Deed, Relinquishment Deed, or Sale Deed has already been executed and acted upon, mere non-fulfilment of promises may not automatically cancel the transfer.The sisters will need to establish that their consent was obtained through fraud, misrepresentation, undue influence, or that the transfer was conditional upon specific assurances.
