In which state court can i file Section 9 HMA

I live in delhi and my wife lives in UP i want to file section 9HMA against my wife. My marriage was performed in UP. Can i file section 9 from delhi.

Before taking the matter in the court it’s obligatory to send a legal notice to your wife. If you live in Delhi then you can successfully file the case from Delhi. It’s hardly matters where your marriage was performed.

Section 9 of HMA can be filed only from the place where both the parties last resided together and from where one spouse has left the company of the other party.
