In mediation center the counsellor said that mediation got failed

I filed sec 9 on my husband. He filed sec 131 ia. In mediation center the counsellor said to me that mediation got failed. You apply for MC, allot MC to me. That means I won the argument? Previously I am working women earns 1lakh per month. At present I am not working. My husband saying that I wont get MC because of my previous experience. Suggest me the possible reasons to get Maintain ace from my husband

If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

The maintenance can be provided as a periodical or monthly payment, or as a one-time payment in the form of a lump-sum amount. If the maintenance is being paid on a monthly basis, the Supreme Court of India has set 25% of the husband's net monthly salary as the benchmark amount that should be granted to the wife.

definitely u will get maintenance if ur mediation had failed will have to argue for taking this in regular court then u can take even u r entitled to get maintenance in DV matter as well if your husband does this with u

You have to file maintenance case and u have to file sec 24 application in divorce case and after all arguments and documents judge will decide and u should get litigation expenses in divorce case specially for further query plz free to call

there is no straight-jacket formula to get or give maintenance. if you don't earn presently then your spouse is liable to maintain you. the court considers the earning capacity of both parties and the actual income of both parties while deciding maintenance. you may not get too much but you will definitely get some maintenance from your husband
