In how many days we need to reply to 125 crpc maintenance petition

Hi,
It needs to be filed within a period granted by the concerned Family Court. Since the provisions if CPC does not apply to 125 petition so there is no prescribed period for filing reply. However, Supreme Court has held that defense can be strike off in case of willful disobedience of the order

30 or 90 days time bound limit to file reply or written statement law is only applicable to divorce petitions and all suits but not applicable to 125 crpc applications. But you have to file the same as per court orders. however court notice also finds mention time within which reply should be filed.

hello, I have went through your query. usually the reply to the application under section 125 crpc is filed on the day you have been summoned to appear before the hon'ble court. but in some cases and under certain circumstances you can also submit your reply on the next date of the hearing after submitting your vakalatnama. hope this was helpful.
