07-Feb-2023 (In Divorce Law)
Child custody with the father. Jewelry made and gifted to the child in the marriage is in possession of my wife. In divorce, will the childs jewelry considered as Streedhan? Or can the court ask my wife to return the jewelyry to the father who has the childs custody.

If gold ornaments are given to child that cannot be termed as stridhan. As it is not defined in Act. Stridhan means only any amount, ornaments or anything which is gifted to girl by her parents and frndz for her amounts to streedhan.

hi in this case the jewelry given to husband and children are not within the ambit of stridhan. whatever given to her is her stridhan. she can claim custody from court but it will be decided as per the willingness of children..
