Contested Divorce Grounds Since the husband is not ready for a mutual consent divorce, a contested divorce can be filed based on specific grounds: Cruelty: Mental or physical harassment is a primary ground for divorce. Even without physical evidence, detailed testimony and statements from family members (like the parents mentioned) can serve as evidence. Desertion: Since the couple has lived separately for nearly three years, this may qualify as desertion, provided the separation was without reasonable cause and against the seeker's wish. 2. The Impact of a New Relationship It is important to be cautious: being in a relationship with another person while legally married can be used by the husband as a counter-claim of adultery. This could complicate the proceedings and potentially impact claims for maintenance or alimony. 3. Legal Steps to Take Send a Legal Notice: Have a lawyer send a formal notice for divorce to see if the husband becomes willing to negotiate a mutual consent settlement, which is significantly faster. Gather Circumstantial Evidence: While direct proof of harassment may be lacking, records of separate living, any police complaints, or even witness statements from neighbors or family can strengthen a case

if you are not working or have insufficient funds are to maintain yourself, or if he has or is harassing you, you can file a domestic violence case and also a police complaint, as you do not want to continue your marriage, you can file a case for divorce on ground of cruelty and also ask for permanent alimony and get divorce.
