In a Mutual Divorce will I get financial support from my husband ?

my divorce case running from 2 yrs in family court, my husband was the petitioner, im the opposite party, now im 30yrs old, i have 2 kids, both or not interest to living with their father. at the same time his also not interest to take of my children. he is eagerly waiting for divorce, i also not interest to living with him. now my question is if i accept the mutual divorce. there is any possibility to getting any settlement for my kids.

The settlement is known as Alimony. All courts are sanction the alimony. In mutual also permanent alimony is possible. The maintenance of kids, spouse includes the matrimonial alimony. Either spouse apply through IA.

Yes., but it should be incorporated in the petition itself for granting of maintenance. So that the court pass order both for divorce and as well for granting maintenance to you and children. In case if you have not mentioned about granting maintenance in the petition ask your present lawyer to do it or file an application for the same.

It has to be stipulated in the MOU. Once mutual consent is filed , then it will be difficult.





















































































We need to incorporate this in agreement.
