Well, if you marry someone without seeking Divorce, then, it will be termed as illegal. Moreover, if your Husband gets to know about your Second Marriage without seeking Divorce from him, then, he can file a Criminal Case of Bigamy against you which is punishable by Jail.

Dear Client, From the information provided, it’s observed that you have separated from your husband, but the separation period is not mentioned. Further, it is observed that you are in relation with someone at present. Please understand that you can stay with live in relationship with someone, but the same can be done once you are legally separated from your husband, otherwise it could be a case of adultery against you if filed by your husband

Dear Client based on your questions, A live in relationship is not illegal even if you are not formally divorced. However since you are still legally married, it may create complications, especially in cases involving maintenance, child custody, or property rights. For further legal guidance feel free to contact us.

Well, if you engage in Second Marriage without seeking Divorce from the first Husband, then, your Husband can file a case of Bigamy against you under the concerned provisions of the Bharatiya Nyaya Sanhita!
