wife denying marital physical relation.tauntinting husband as black coloured, white haired ,dollu hotte (fatty) middle aged showing no interest.she denies divorce filed by husband and refuse to enter her rented house what to do. does her taunting comes under criminal prosecution .ipc.

As in a case family court while awarding divorce held that if a women repeatedly taunts her husband for not being up to the mark, it amounts to mental cruelty. As SC held that in considered opinion, cruelty or harassment need not be physical. Even mental torture in a given case would be a case of cruelty and harassment within the meaning of Section 304-B and 498-A IPC.

Dear Madam, Such tauntings cannot be taken as serious one because husband and wife are two faces of a coin. Both of them have a right to taunt each other and such verbal wordings cannot be taken as serious and no criminal case can be launched on such tauntings. Further, husband cannot get divorce on such verbal abusive words.
