If I file a divorce case can my husband deny for divorce ?

Sir, I got married 2008 and in 2011 has to left husband’s house and leaving with my parents. Due to husband cruelty, demand, mental torture I had to take shelter at parents house. No one complaint written in police station now i want 2015 get divorce .I am not connected with husband family and other members directly or indirectly. Now I want to get legal divorce from him. Quest: If I suit divorce case husband denies, will court stop divorce or not process divorce? Quest: Husband can demand money for divorce? Quest: Can I get my jewellery back?

you can certainly file petition for divorce on the ground of cruelty and desertion against husband also claim for maintenance from him in district family court of . your husband can not ask for money or jewelry back or any other favor from you.

Yes you may file case of divorce based on cruelty & desertion. Ur husband may deny ur allegations but u have to prove vice versa. U will get divorce. U may claim all ur jewelry & items. U am also ask for maintenance

As per your query, i see that you have not been living with your husband since 2011. In that case you can file a case for divorce on grounds of desertion and mental cruelty. If he denied to give divorce, that would amount to him contesting the divorce. I always suggest that you should consult a lawyer and set up a strategy. Furthermore, yes you can claim your jewelry. That won't be a problem. No, he cannot demand any money from you. Rather you may claim maintainance.
