If husband nd wife both have a center govt job nd wife earn more than husband so please say wife claim for maintance??

A wife earning more than her husband is generally not entitled to maintenance under Section 125 CrPC or the Hindu Marriage Act, 1955, as courts have ruled that a financially independent wife cannot claim support. However, if she proves financial hardships, medical expenses, or liabilities affecting her standard of living, the court may consider her claim. Under the Domestic Violence Act, 2005, she may also seek financial relief if she establishes the need for support despite having an income.

She can file a petition for maintenance but If the wife is having a good income to support herself and her kids(if any living with her) , the court would decline her claim for maintenance. The Husband must contest the claim as there is no automatic rejection of such petitions.
