If Case goes EXPARTE will Court Consider our written facts & exhibits?
26-Sep-2023 (In Divorce Law)
Wife filed false DV Act case as well as Divorce with false allegations. Court sent summons but couldn't go due to lockdown.
Court is far away so unable to travel or find someone there.
So, we have sent a written statement of facts along with the evidences to the Court. Would the case go for exparte even during this Corona situation?
Question: If case goes to exparte would Court take into consideration the exhibits and written facts we have already submitted to Court?
We cannot go to hearing as it is too far away, so submitted by post our statement of facts and exhibits.
Submission of written statement or documents via speed post is futile. It has to be filed as per the due procedure by an advocate or if you appear in person so with the approval so granted. The court will not touch the set of papers if you have sent. You can get the matter transferred at your place if travelling is not possible for you. Hi,
You couldn’t travel due to lockdown is a good ground, but you need to file an application for recalling of orders, if the honble court have directed for exparte proceedings.
You have not made it clear whether you have filled the written statement/reply in a legal language or you have simply stated your stand.
Thanks
