Hi there, firstly we'll have to see what proof is available with you regarding their intentions. Secondly, if those proofs are admissible in court or not. Thirdly, what proofs does she has and how strong is her case against you. Based on this, these proofs can be utilised but still it will only help to cut down the alimony amount but no exempt it completely. It's advisable to contact me and provide more details to assist you better.

If you can prove that your wife and her family married you with the pre-planned intention of seeking divorce and alimony, it may amount to fraud or misuse of law, and the court can deny or reduce her claim for maintenance and alimony. However, until such fraud is legally established through evidence, the court may still order interim maintenance. Ultimately, the decision will depend on how convincingly you are able to prove the fraudulent intent before the court.

Yes, a husband can be bound to pay alimony and maintenance in India, but the reverse is also possible if the wife is financially independent and the husband is unable to support himself. Under Indian law, a spouse (whether husband or wife) can seek maintenance or alimony after a divorce if they are financially dependent on the other spouse. The court considers factors like the income of both spouses, their standard of living, financial status, and each individual's financial need to determine the amount of maintenance.

If you can prove that the marriage was done based on some plan to extort money you need not pay. There is adequate judgements by the Hon'ble Supreme Court which clearly mention that in cases where marriage is done out of intention to commit fraud, one is not bound to pay. You can call to discuss with complete details
