Hi madam, I am advocate prabhakara shetty of Lawrato. I am in Bangalore and am practicing many muslim cases and done some cases of khula also, Khula is not given by a muslim wife to her husband. It is offered by her. to husband and will take effect only when husband accepts it. But is a waste if he declines. if in your case your husband declines then you can meet me to discuss your second option.

Dear Sir, If Husband Refuses You can approach the Family Court under: Dissolution of Muslim Marriages Act, 1939 (India) Grounds include cruelty, desertion, non-maintenance for 2+ years, husband’s impotence, or failure to fulfill marital obligations. You will file a petition for Khula/divorce before the Family Court through a lawyer. The court may grant divorce even without the husband’s consent if valid grounds exist.
