Before one year of marriage a divorce petition cannot be filed if you and your husband is ready for divorce then you both can file a petition for divorce after one year and get divorce, before one year it is not possiible unless you show some valid reasons.

Yes you can file petition for divorce but u have to wait for another six months as law there is provision marriage after divorce one year has to pass and u can file mutual divorce under section 13b of Hindu marriage act.

You can file for divorce, but if your spouse does not want to give divorce and decides to fight, it will take quite some time. You also need to show some proof of the grounds of cruelty that you mentioned.

As of now you cannot file a divorce petition before the family court as per the family court act and Hindu marriage act as the statute states that one year has to elapse from the date of marriage to entertain a divorce petition by the court. So i suggest you that in case you do not wish to continue the marital relationship with your husband then sign an MOU(Memorandum of Understanding) to the effect that after the lapse of one year he(husband) should co-operate with you regarding filing of mutual divorce petition before the jurisdictional family court.
