I wanted to file contested divorce against my wife

26-Jan-2023 (In Divorce Law)
I live in Maharstra and my wife is in different state,so i wanted to file contested divorce. My query is as we both live in different states so do i need to "be present physically for every hearing in court" or "my family member can attend on behalf of me in court". As i guess contested divorce takes a long time,as my wife refuses to give divorce,so what are the strong reasons & proof that i need to give to court. My wife daily fights with me for silly reasons, scolds me & my parents & i have audio recordings as proof but is this only sufficient reason to get divorce, will my divorce be granted or dismissed by the court

Hi

In this case you can proceed to file divorce proceedings in Maharashtra. You can also file it through the power of attorney. Abusing you and your parents amounts to cruelty, as you have audio recording, it is admissible in the court of law therefore you have strong chances of getting divorce.

Dear queriest, as per your query you have mentioned about the fact that your wife fights with you for silly reasons and scolds you and your parents for no reason and therefore you want to file divorce, as per your query it seems that you and your parents are been victim of cruelty from your wife and such act should be made noticed to the women's cell and in the police station, wherein you will be safe in future, for further discussion kindly call me so that it can be easy to discuss and to take further legal step appropriately.
