i want to make my marriage unregistered in india
05-Aug-2023 (In Divorce Law)
I married a German citizen on 24/03/2011 in New Delhi, marriage registered in court on 25/03/2011.
After the marriage, my wife returned to her country, Germany, and I set out to obtain a family reunion visa.
On 18/09/2011 I joined my wife in Berlin, Germany and we lived there for about 6 months but later, on 30/03/2012 I returned to India and since then I haven't seen her again.
My wife filed for divorce with the German authorities and obtained the sentence on 16/12/2014, and only recently my ex-wife sent me the legal documents of the aforementioned sentence.
Now, I would like to validate the divorce also in India and I have a few questions to ask:
1- what procedure I have to follow to make it legal also in my country.
2- which office should I go to?
3 - what is the timing for completing the divorce?
Greetings to you.
Since you have already been divorced by the concerned court of Germany, the divorce is valid. Now what you can do is to find a lawyer and you must approach your concerned court and file a an Application for Declaration of Divorce whilst annexing the Divorce document/Order issued by the court of Germany.
Pertaining to how much time it might take, depends on the skills of your lawyer and also your concerned court.

You may initiate divorce proceedings under the special marriage act. It needs to be by mutual consent of both the parties for the proceedings to be hassle free. Further and better particulars are needed for an effective opinion.
