i want to file divorce. I don't want to live with my wife.

my wife is not living with me for last 10 months. she doesn't want to live with my mother who is cancer patient. she wants that i just leave my mother but I can't do this. now i want to file divorce but i fear that she can file counter case against me like dowry. so please advise me how can i file divorce safely.

no you don't need to feel scared about it. you can file the petition on the ground of your ill mother and through your mother you can file domestic violence case on your wife so that her any alligation will be defeated. And on the ground of I'll treatment with your mother u can file for divorce petition under section 13 which could be granted well.

if you file divorce then your wife counter against you, but you can file u/s 9 restitution of conjugal right, then you can convert it into divorce petition, judicial separation is the best to you ,then you can convert if into divorce.
