I want to file a case against a person who used me

06-Jan-2026 (In Divorce Law)
I am 20 , I wanted to know whether I can file a case against my ex who came into relationship, used me physically , I agreed because I thought he genuinely loved me which he didn't, since he is in Indian army as his posting came he left and broke up with me , later on when he met me ,again he used me physically, so I want to know how can I file a case against him without my family involvement because I don't want them to indulge in this matter. Kindly respond

From the facts stated, legal remedies may be available if it is established that consent for the relationship was obtained through deception or a false promise, and not merely due to a failed relationship. Courts carefully examine the intention of the person from the beginning, and such matters are decided strictly on facts, evidence, and surrounding circumstances. Since the applicability of criminal provisions depends on specific details, proof, and timelines, it is not advisable to proceed on assumptions. A careful legal assessment is essential before approaching the police, as an incorrect step may weaken your case or cause unnecessary complications. You may proceed independently without family involvement, but you should first consult a lawyer in detail to evaluate your facts, preserve evidence, and decide the most appropriate and lawful course of action. A confidential consultation will help you understand your rights and the correct procedure.

You are a major (20 years old) and legally entitled to take action on your own without involving your family. If physical relations were established on a false promise of love or commitment, and you later realised that the promise was never genuine and was only to exploit you, it can amount to a criminal offence. Depending on facts and evidence, offences like cheating and, in certain circumstances, sexual exploitation on false promise may be examined by the police/court. You may file a written complaint/FIR at the police station where the incident occurred or where you presently reside. If you are uncomfortable going alone, you may approach the Women Police Station/Women Cell. You can clearly request confidentiality and state that you do not want family involvement. Your statement will be recorded privately. If the police do not act, you can file an application before the Magistrate under Section 156(3) CrPC seeking directions for registration of FIR. Being in the Army does not give him immunity from law. It is advisable to consult a lawyer personally with all details, messages, chats, call records, or any proof you may have, so proper legal steps can be taken while protecting your privacy and dignity.
