By his name it appears that you both are Hindus by religion . you need to take a divorce order that is judgement from a Court . if your spouse is willing you bith can file a mutual consent petition . if not you alone can file for divorce but you should be having proper Grounds to do so.

There are several modes of divorce but mutual divorce is easiest method wherein you can settle the matter and get divorce after cooling period of 6 months. Otherwise file contested divorce and it may take 2-3 years time. If you do not want any alimony then you will get mutual divorce very easily.
