I want to change my lawyer. Do I need to pay money If I changed him

We hired lawyer filed sec13 1ia. He also filed counter for sec9 which was filed by my wife. For both filings we paid money to my lawyer. From last 3 years case was dragging. Current status for both cases are pending one time my lawyer cross examined her. I am not satisfied with my lawyer. If I continue my cases with another lawyer do I need to pay money to my lawyer? How to get papers from my lawyer?

based on your question you can change your lawyer and engage another lawyer. if you want to change your lawyer you have to send NOC then you can proceed further.

Dear Sir,
Order THREE of Civil Procedure Code gives aggrieved persons the right to choose one’s pleader. Therefore changing of pleader with the leave of the Court is possible. The new pleader should submit a duly signed Vakalathnama to the court. Hence it is possible to change one’s pleader. In a few cases problem arises with the case history. If the pleader fails to give it to the client, the client can apply for the order sheet by an application to the Court.

In normal Courts, NOC (No objections certificate) to be taken from the previous Advocate. The previous advocate may sign on the left margin of Vakalathnama (Power) saying he has no objection to engage any other Advocate.

While giving case to your present lawyer you must have fixed the amount and the stages of payment with him. you can pay as per present stage and ask to give you the file and a NOC in a vakalat form and take that to your new lawyer.
