I want separation from my wife

02-Sep-2023 (In Divorce Law)
Sir, I am a govt employee and lives in delhi. I married to my wife before 04 months in Arya samaj mandir. She is still with their parents as she wanted me to remarry her with customs which I refused. She often used to give me threats of committing suicide. Recently she has attempted suicide to persuade me to remarry her with customs. Finally she agrees to come and live with me. But I don't want to keep her anymore as she may continue her suicidal tendency in future and ruin my life. Can I refuse her to keep with me even after 04 months of marriage or I should wait to complete 01 year to file a divorce petition and keep her with me till that time? Please suggest what should I do?

As per the Hindu Marriage Act petition for divorce can be allowed only after one year but it is the discretion of the Court to allow the petition even before it if the problem is so grave. And giving suicidal threats is not acceptable. Firstly you should file a legal complaint before your nearest PS to intimate them about the situation you are facing.

You can take a precautionary measure by filing an installah peshbandi application with the concerned authorities enunciating the potential threat of suicide by your wife. For divorce you have to wait for 1 year but you can file a judicial separation
