I want divorce and custody of my kids

I m kiran. I have two kids living with me. I came back from my husband home on 16th March 2012. Till now I m saparted. He doesn't spent his single penny on my kids. I have a daughter 12 year and a son 8 year. They also don't want to live with him. I need divorce and custody of my kids. Plz suggest
File an application for maintenance on behalf of your daughter and son u/s 125 cr.p.c
and also file a divorce petition . u/s 13 for divorce .
when the husband comes forward in case you ill be sent for conciliation then that time inconsultation with your lawyer settle the terms and further line of action.
