I have applied for a divorce and wife filed 498a and dvc

17-Dec-2023 (In Divorce Law)
I have filed a divorce petition under HM Act 13 1a,1b. after10 days wife filed 498a,506 and after 10 months she filed a DVC case. both are in still in progress. is it considered as cruelty as per below. Divorce on the grounds of cruelty and desecration – Wife filing a criminal complaint against husband as a counter blast to divorce petition filed by him. Amounts to cruelty. Wife at that time residing with her parents and had the support of parents and brothers in filing that case.

Dear Sir, It does not amounts to cruelty because your wife has exercised her legal rights. She may say that to save the marriage she has not lodged complaint you are advised to get anticipatory bail and approach High Court in both the cases and try to get stay over both the pending cases.
