17-Sep-2023 (In Divorce Law)
i filed complain in women cell stating sexual harassment by father in law, dowry demands, not returning streedhan, cruelty. FIR not registered yet, 3 counsellings done, police is delaying FIR. But husband filed for divorce. Does my FIR / further future cases of 406, 498a will loose its impact because of women cell has delaying my FIR. will court consider my complain date too as it was filed before Divorce petition by him or only FIR date will be considered. my mother in law has also filed police complain stating that i took her jewellery with me. i want to contest divorce case, i have filed 125crpc after he filed for divorce. what to do so that my cases don't loose value in the eyes of court despite of his divorce case, mother in paw police complain

firstly lodging FIR on grounds of 498a shall be ineffective because as per 2nd july 2014 it has been stated by apex court that no arrest shall be made. police usually doesnot register FIR its a common practise, send your complaint to OC and SP by speed post. in 125 proper steps needs to be initiated for proper relief, dont get misguided

your allegations are very grave and if they are not true but only a mode of expressing vengeance towards your in laws then I would ask you to reconsider them. but in case they are as you have expressed them to be then do not worry law has many avenues to help you register your FIR and the delay will not be fatal to your case either. you can file the FIR through three ways - one directly complain to the police station, second by writing the complain to the concerned SP or commissioner as the case may be. third by making a compliant directly before the magistrate. (CJM). So you have to adequate alternative avenues to explore. as far as fake complaint lodged against you are concerned you can always get defamation lodged against them after you get acquitted in those charges. so they will be lodging those complaint at their peril. your 125 CrPC maintenance case can go on independently of any other case. so you need not worry at any count.
