If mutual consent is not possible, you may institute a contested divorce on grounds such as cruelty, desertion, or domestic violence. Alongside, you may move interim applications for custody of children, maintenance, and protection. The court can grant urgent reliefs on custody and residence even while divorce proceedings are pending. It is advisable to engage a family court practitioner to ensure speedy filing and to seek waiver of statutory waiting period.
