I am trying to make my husband understand me every thing I have tried but he still abuses me so badly and even tortures me for dowry etc. He abuses my parents too. He beats me and even his family takes his side even my FIL told me he don't care at all he will get his son married again asap. What to do and whats right I am not able to understand. I have a daughter too with him but he never understands and tortures me mentally too. Nobody cares of me & my daughter even the other members also same.

हिंदू विवाह अधिनियम, 1955 में धारा 13 13 तलाक. — (1) कोई भी विवाह, चाहे इस अधिनियम के प्रारंभ होने से पहले या बाद में हुआ हो, पति या पत्नी द्वारा प्रस्तुत याचिका पर, तलाक की डिक्री द्वारा इस आधार पर भंग किया जा सकता है कि दूसरा पक्ष- 16 [ (i) ने विवाह संपन्न होने के बाद, अपने जीवनसाथी के अलावा किसी अन्य व्यक्ति के साथ स्वैच्छिक संभोग किया है; या] 16 [ (आईए) ने विवाह संपन्न होने के बाद याचिकाकर्ता के साथ क्रूरता से व्यवहार किया है; या] 16 [ (आईबी) ने याचिका की प्रस्तुति से तुरंत पहले कम से कम दो साल की निरंतर अवधि के लिए याचिकाकर्ता को छोड़ दिया है; या]

I'm sorry to hear that. Mental cruelty is a ground of Divorce but difficult to prove in a court of law. We will need adequate proof of cruelty and also income/ property documents of your husband to take it forward.

hello mam, if your husband and his family members abuse you mentally and physically thn you should take the legal action against them....you can file a criminal case against them and ask about maintenance for you and your daughter....for further discussion do contact ...

if your husband torture you for dowry then you should be able to file a case or FIR at nearest police station or court in various sections of IPC like 323,341,406,498A etc..nd u can file a application for mentinens against your husband..
