I am 32 year old middle-class man, unhappily married for 1.6 years, no kids. I am staying in a rented house with my wife, I don't have any assets or property on my name. Financial situation is bad. I want to file for a divorce and I don't want my wife to stay with me. I pay the rent and everything in house. Is there any legal notice that I can send her and her family, requesting her to vacate the house untill divorce completion. Please advice.

It is not possible to ask your wife to vacate the house before completion of divorce. It is also not possible to file a case for divorce unless both have been residing separately for more than 1 year. So it is better to file a Joint Divorce Petition for mutual consent.

you can file a divorce case and after receiving notice there are more chances that she will vacate the house and go to her parents or friends house to seek advice and guidance, you have to file application stating solid reasons, so better first file divorce petition thereafter I think she herself will vacate the home.

Sir, I think where there is no provision to vacate your wife from your house, but you can send a legal notice for divorce. The divorce notice must be contained about the divorce ground like as cruelty or impotency, or any incurable decease or adultery. whatever you stated in the notice, that to be subject to prove the relevancy of the fact.
