Husbands family torturing me and pushed me out of home

I am hindu.marriage 2013 ko hua tha. My age 29, have a baby boy. Husband's family tortured me and drove me out from my home. Husband is a govt servant. His sister tortured me and demand for a house. They file a divorce petition. From one year they dont give me any financial help. Divorce background is am not staying with him, dont take care of his father and dont cook food, slap to his sistet etc. But all r false his father stated at woman commission my daughter in law is good, and I have photograph with my husband on my son's birthday.

You can approach your nearest police station for filing a complaint against your husband and your in laws. And moreover for the time being for your maintenance you can file a case u/s 125 crpc for an interim maintenance of you and your child.

Mam, all this queries cannot be answered online. It needs face to face conversation. Anyway, you can file a petition for restitution of conjugal rights, claiming to husband to take back you.
2ndly You can file a petition U/s. 125 Cr. P.C or under D.V. Act for maintenance etc.

In the given set of facts and circumstances, you can seek various remedies as provided under the law. You can apply for an ex-parte interim maintenance under Section 125 Cr.P.C. You have to demonstrate on your affidavit that you have been neglected by your husband to maintain you despite he having sufficient means and you being unable to maintain yourself. Since you also have a child, you can get the benefit in the case.

As you have stated that your husband has instituted a divorce proceeding, you can seek for interim maintenance under the provisions of Hindu Marriage Act as well.

You can also take recourse under the provisions of the Domestic Violence Act whereby you can seek a right to residence as well.

You are advise to file for in local police station regarding torture and demand of of money and house, further you are advise to file case for maintenance and proceeding under the domestic violence Act

As you stated the allegation are false in this case the view of your husband is important. Try to sort out the difference during conciliation. In between you may seek intervention of an appropriate court to grant you maintenance .
